December 16 Gang Rape Convicts To Hang, SC Rejects Review Plea

It said the convicts were heard elaborately during appeals and no grounds have been made out for review of its verdict.

The apex court had in 2017 upheld the death penalty awarded to the four convicts by the Delhi High Court after which three of them - Mukesh (29), Pawan Gupta (22) and Vinay Sharma (23), had filed a review petition.

Akshay Kumar Singh, 31, did not file a review petition.

A three-judge bench, headed by Chief Justice of India (CJI) Dipak Misra, maintained that a review of the Supreme Court's verdict of May 5 past year would have been necessary only if there were "errors resulting in miscarriage of justice".

Earlier this year, the issue of women's safety erupted again after an 8-year-old Muslim girl was gang-raped and killed in the northern state of Jammu & Kashmir and a lawmaker from the governing Bharatiya Janata Party was arrested and charged with raping a teenager.

More than 370 convicts were on death row as on December 2017, the last official count, down from 399 the previous year.

The woman was gang-raped by the six people present and violated with an iron rod when she protested.

Three rapists have filed a petition for review of the death penalty. A minor in the case was convicted by the Juvenile Justice Court and served a three year sentence.

The case, which scarred the nation, had headlined across the world, triggering big changes to laws on sexual crimes against women.

She succumbed to injuries in September 2013. Failing to get any relaxation in death sentence from it, a mercy plea before the President would be the last resort for them. "The court has taken a decision against these kids (convicts) under political and media pressure", A. P. Singh told reporters.

There were some 40,000 rapes reported in India in 2016, according to the most recent official figures available.

The first declaration was recorded by a doctor when she was admitted to hospital on the night of December 16, 2012 and the second on December 21 by a sub-divisional magistrate during which she gave exact details of the crime.

Interestingly, the committee was opposed to the death penalty as a punishment - even in the rarest of the rare cases.

The case led to the introduction of the death sentence for raping girls under 12.
